Terms of Service
Effective Date: August 1, 2026
These Terms of Service constitute a legally binding agreement between you and Morning Dive Underwater Imagery.
1.Services
Morning Dive provides underwater photography and film commissions, pool studio sessions, open-water and expedition shoots, art direction, retouching, editing, and print and artwork delivery.
2.Eligibility
Clients must be at least 18 years of age to book. Junior sessions (ages 2–18) must be booked by a parent or legal guardian, who must be present for the entire session.
3.Water Safety and Assumption of Risk
Being in and under water carries inherent risk. You confirm that every subject is water confident, in good health, and has disclosed any relevant medical condition. Safety staff are present on our shoots, but you voluntarily assume the risks of participation and agree to follow all safety direction on set.
4.Booking, Payment, and Cancellation
A non-refundable retainer confirms your date and is applied to the commission fee. The balance is due as set out in your commission agreement. Weather, water conditions, and location permits may require rescheduling. See our Cancellation Policy for full details.
5.Image Rights and Licensing
Morning Dive retains copyright in all images and footage. Clients receive the usage license described in their commission agreement. Commercial, editorial, or advertising use beyond that license requires a separate written agreement. Delivered files may not be re-edited, cropped for publication, or filtered without written approval.
SMS Terms of Service
6.Program Name and Description
The Morning Dive SMS Program provides shoot reminders, scheduling and call-time updates, delivery notifications, client support communications, and promotional messages where consent has been obtained.
7.Opt-Out Instructions
Reply STOP to unsubscribe. A confirmation message will be sent.
8.Rejoining Instructions
To rejoin, sign up again, provide new consent, or reply START if applicable.

Reply HELP for assistance or contact info@morningdive.com.
10.Carrier Liability Disclaimer
Wireless carriers are not liable for delayed or undelivered messages.
11.Message and Data Rates
Message and data rates may apply. Message frequency varies.

The SMS Program complies with applicable laws and 10DLC standards.
14.Legal Compliance
Clients agree to comply with all applicable laws, location permits, and venue rules at pools and open-water sites.
15.Intellectual Property
All Morning Dive content, imagery, and film work is protected by copyright.
16.Disclaimer of Warranties
Services are provided as-is. Creative outcomes are subjective and cannot be guaranteed to match any specific reference image.
17.Limitation of Liability
Liability shall be limited to the amounts paid for the commission in question.
18.Governing Law
These Terms are governed by California law.
19.Modifications
Morning Dive may revise these Terms at any time.
