Morning Dive Underwater Imagery

Privacy Policy

Effective Date: August 1, 2026

Morning Dive Underwater Imagery ("Morning Dive," "we," "our," or "us") takes the privacy of the people we photograph seriously. This Privacy Policy describes how we collect, use, maintain, protect, and disclose information obtained through our website, our commission and booking process, our shoots, and our client room.

1.Information We Collect

  • Personal identifiers: name, email address, telephone number, mailing address, company or agency, and emergency contact details when voluntarily provided.
  • Shoot information: creative briefs, locations, dates, swimming ability, comfort in water, relevant medical notes, and — for junior sessions — the age of the subject and guardian contact details.
  • Images and footage created during a commission, together with any usage or release terms agreed with you.
  • Financial information processed through secure third-party payment processors. We do not store card numbers.
  • Automatically collected data including IP address, browser type, device information, and website analytics.

2.Use of Information

We use personal information to answer enquiries, quote and plan commissions, schedule shoots and pool studio time, deliver galleries and films, process payments, improve our services, comply with legal obligations, and stay in touch with clients.

3.Images, Likeness, and Consent

We do not publish, exhibit, or use client images for marketing without a signed release. Private commissions remain private by default, and images of minors are never published without written guardian consent.

4.Text Message Communications

By opting in, you consent to receive shoot reminders, scheduling updates, delivery notifications, client-care messages, and promotional messages where authorized.

Message frequency may vary. Message and data rates may apply.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

Text messaging originator opt-in data and consent will not be shared with any third parties, except with aggregators and service providers necessary to facilitate the delivery of text message communications.

5.Information Security

We maintain commercially reasonable safeguards designed to protect personal information and unreleased imagery against unauthorized access, misuse, or disclosure. Client galleries in the client room are access-controlled.

6.Disclosure of Information

We do not sell personal information.

We may disclose personal information to service providers (such as retouchers, labs, scheduling and payment platforms), as required by law, during a business transaction, or with your consent.

Required SMS compliance disclosure:

No mobile information will be shared with third parties or affiliates for marketing/promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

7.Children's Privacy

Junior sessions (ages 2–18) require a parent or legal guardian to book, consent, and be present on set and poolside. We do not knowingly collect information directly from minors.

8.California Privacy Rights

California residents may have additional rights under applicable law.

9.Third-Party Websites

Our site links to third-party platforms such as YouTube and payment providers. We are not responsible for their privacy practices.

10.Changes to This Privacy Policy

We reserve the right to modify this Privacy Policy at any time.
